学术造假是指剽窃、抄袭、占有他人研究成果，或者伪造、修改研究数据等的学术腐败行为。学术造假首先是一种违背学术道德和科学精神的表现，对个人、社会、国家将造成致命的威胁和损害，但同时学术造假本质上又是社会各种腐败现象在学术上的一种反映，因此，造成学术造假滋生的根源是非常复杂的， 我主要从以下几个方面来追寻学术造假的原因。
功利原因
近些年来，在巨大的市场经济诱惑之下，道德和信仰等约束力量逐渐淡化，人们对于名与利的追求欲求无限制的膨胀是产生学术造假的根本原因。由于他们急功近利的价值取向，为了赢得社会和学界的认可，科学态度和求实精神被弃而远之，只要能提高自己的学术地位和带来荣誉，就不择手段地大肆剽窃他人成果。学者这种道德滑坡，伦理缺失，自律放松，要求不严，造成学术造假活动的日益猖獗。
制度原因
造假、腐败这种行为在各行各业都有发生，但一而再、再而三地在学术界出现，这就说明相应的治理措施、制度建设跟不上。可见，目前我国的学术制度存在严重的问题，主要表现以下几个方面：
1、学术治理体制行政化。我国现行的学术治理机制沿袭了计划经济时代所形成的行政式治理模式，对学术成就的评价集中表现就是僵化的量化评估，在学术奖励、职称评审等活动中普遍存在重形式轻内容、重数量轻质量、重奖励轻实用，我国学术上这种行政式的量化治理模式从总体上阻碍了我国科研水平的提高，同时也刺激了学术不端行为的发生。
2、学术评价体制不完善。近年来，学术评价活动被引入到复杂的人际关系领域，偏离了正常的学术评价的轨道。一种是不管学术本身怎样都极力叫好，毫无“评”可言；另一种则是随意批评或借学术批评压制别人，挟私报复。这些挟带着浓重私人感情色彩的评价背离了学术批评的初衷，也经常使学界陷入混乱和纠缠之中。
3、学术监督制度缺位。目前我国对学术问题揭露不及时，防范制止不力，学术监督制度严重缺位，使得很多学术造假现象难以得到有效识别。我国学术造假现象已经非常严重，但这种非常严重仅是在没有得到充分揭露和曝光之下统计出来，又难以被发现又惩罚很轻的学术违规行为，显然，其所付出的成本远低于造假所获得的收益。
处罚原因
从法律的视角看，目前我国还没有制定系统的惩治学术违规的法律制度和完善的预防办法。目前，我国对学术造假的处罚相对一般造假而言简直就是微不足道，一般是对相关者的惩处也多以批评、教育或者扣发奖金为主，最严重的莫大过科技部介入调查，最后也仅仅是造假者撤职收场，无法对学术造假者形成足够的威慑。
学术造假包括包括学术腐败、学术不端、学术失范等形式，其中学术腐败是指利用学术资源谋取非正当利益或者利用不正当资源谋取学术利益，如权学交易、钱学交易、学色交
易等；学术不端主要是指学术从业人员有意识地进行的学术违法违规行为，如抄袭剽窃、实验数据作假、伪注等；学术失范主要是指学术研究及成果发表中存在的违背学术规范与学术伦理的学术偏差，如一稿多投、低水平重复、粗制滥造等。
目前对学术造假者，除各单位内部处分外，暂无追究法律责任的依据。从行政处罚看，我国根本没有对学术造假进行处理可依据的法规。
当前我国法律对学术不端的惩治力度非常小，而现行法律条款中，如果被抄袭人本人不起诉的话，抄袭人就不用负法律责任。
对于抄袭剽窃类纠纷，版权局只能调解，当事人不接受调解的，需到法院起诉。而法院方面受理这类案件时，通常会委托专家委员会进行鉴定，如果专家意见出现分歧，法官的自由裁量权便相对较大。
针对上述所分析学术造假产生的原因，杜绝学术造假的发生应从以下几点做起： 1 学术造假首先是造假者的道德品质问题，所以关键是要提高广大学者的学术道德水平，杜绝学术功利主义的蔓延。首先，尽快出台全社会通用的学术道德规范。另一方面，高等学校、行业协会、专业学会需要广泛开展学术道德教育活动，包括学术规范知识、知识产权知识和学术道德知识的宣传教育普及工作，倡导学者自觉遵守学术道德，加强自律。
2、改革学术管理机制。改变当今只重形式和数量的管理模式，转为重质量和内涵，建立一套科学、合理的学术质量评价体系。（1）引入评价机构或同行专家评议制度。专家必须是同行且有一定的权威和较好的道德素质才有资格担当评审。（2）在学术评审中，采取多种形式和途径对评审过程进行全方位、全过程公示，增加评审透明度。同时，在评审前后均可提出异议，接受公众举报，查处违反学术道德的一切行为。
3、建立健全的学术监督机制。（1）成立专门机构。我国也应该建立专门机构，监督检查各种学术腐败防治情况，受理并调查学术违规举报，处理学术违规人员。（2）拓展其他监察渠道。主要包括加强学术活动的舆论监督在有关报刊、电台、电视台、网站上定期揭露和曝光学术领域违法违规行为，全社会重拳出击，共同打击学术造假行为。
（三）法律
1、出台适用全社会、具权威性的《学术规范》。
2、明确法律处罚措施，对违法行为令行禁止。

In the illustration provided, authors of what should be unique articles peer over at their colleague’s work. Perhaps they are looking for inspiration, but more likely, they are stealing ideas and using these ideas as their own. Academic plagiarism is a problem that is not limited to one or two schools in the word. One can only imagine that some form of academic is present everywhere. This process can occur innocently enough. One writer is looking for information on a certain topic and does not cite his work properly, the orignal author is forgotten, and credit is not placed where it is due.
I believe that this issue is a very serious problem in universities today. The administration should do everything they can to stop plagiarism. This could include lecturing students on how to properly quote references, and also raising the penalities for those who are found guility of plagiarism.
